IMO You should be able to capture all visitors as long as they aren't seen to be captured by other faction members.

The faction loses 1 rep with you if a solo visitor doesn't return (even by Pirate death) and you lose 20 rep if that faction member is seen as part of your colony (Prison doors/draft will prevent)
